3 months na palugit sa di nagbabayad ng rent ng bahay?batas ba yun

    SEC. 9. Grounds for Judicial Ejectment. Ejectment shall be allowed on the following grounds:

    (a) Assignment of lease or subleasing of residential units in whole or in part, including the acceptance of boarders or bedspacers, without the written consent of the owner/lessor;

    (b) Arrears in payment of rent for a total of three (3) months: Provided, That in the case of refusal by the lessor to accept payment of the rent agreed upon, the lessee may either deposit, by way of consignation, the amount in court, or with the city or municipal treasurer, as the case may be, or barangay chairman, or in a bank in the name of and with notice to the lessor, within one (1) month after the refusal of the lessor to accept payment. The lessee shall thereafter deposit the rent within ten (10) days of every current month. Failure to deposit the rent for three (3) months shall constitute a ground for ejectment. The lessor, upon authority of the court in case of consignation or upon joint affidavit by him and the lessee to be submitted to the city or municipal treasurer or barangay chairman and to the bank where deposit was made, shall be allowed to withdraw the deposits;

  • Kung by mouth lang ang lease of the house, posible sila paalisin - take note wala din sila pinanghahawakan na tenant sila - pwede mo sabihin na pagpunta mo dun sa bahay may nakatira na - hehehehe :D

    To be serious, there should have been a contract. It is for the protection of the landlord and the tenant.

    Ngayon since andyan na yan pa baranggay mo na lang para magkapagusap kayo at least documented na aalis sila sa Sept 30. Pagdating ng sept 30 di sila umalis pwede ka na humingi ng tulong sa baranggay to evict them.

    ang ginawa ng Mother ko nag punta sa lawyer , pinakasuhan nya ng trespassing,
    ayon nung narecieve nila ang Letter , umalis din at nagbayad ng 3 months

    nagbayad din kami sa lawyer pero at least nakuha namin yung 3 months na payment.

    lagi na kami nag papa 2 months deposit/advance then contract

Hindi nagbayad yung tenant, umabot ng 5 months, pinabarangay. sa barangay kailangan pa ng 3 hearing bago umabot sa korte hindi kami tinulungan ng barangay para mapaalis puro usap lang talaga. nung dadalhin na namin sa korte umalis yung tenant, walang bayad, pati kuryente tubig wala. ngayon hindi na namin mahabol, suggestion ko sayo ifile mo na agad sa barangay para mabilis.
  • dapat talaga may written contract lalo na kung pamilya ang nangungupahan..




    kung single na man tapos maganda pa pwede na "oral" agreement

  • Eto ang complication/s ng kawalan ng kontrata. Nagagamit pa ngayon na dahilan ng tenant ang technicality ng batas makapanglamang lang. Siguro dapat lang na idulog mo na ito sa kinauukulan like sa barangay nyo to prevent further complications pa.

  • Sad to say...biktima rin kami nito...May umupa, ayaw na magbayad, pati kuryente at tubig, at ipinagmamalaki nga yang batas na yan...

    That damn law protects the criminals...and not us law-abiding citizens..

    May kontrata pero regardless daw...yun pa rin ang batas...already asked a lawyer about it and he confirms it.
  • pano po ang gagawain kapag di binalik ng landlady ko yung one month deposit ko
