  • With the exception of BIR... kadalasan practice ngayon eh mag-open na lang basta ng negosyo at saka na lang bayaran ang City Business Permit kapag NASITA na ng roving permit inspectors. Pero hangga\'t hindi pa.... dedma na lang muna. minsan kung tatamad tamad o tago ang lugar mo at bihira rondahan ng inspectors..baka makalusot ka pa ng ilang taon.

    One caveat nga lang... kapag nasita ka na malapit sa LAST QUARTER (Oct to Dec) of the year... magbabayad ka pa rin ng Permit para sa buong taon na yun. But only for that year lang. Lusot na ang mga nakaraang taon kasi palalabasin mong bagong bukas ka lang eh.
    Come the following year in January.... bayad ka ulit dahil bagong taon na eh. Panibagong singilan na naman. Hehehe...

    Sometimes napapakiusapan naman ang sumisita na kung puwede sa January or start of the year na lang magbayad ng permit para hindi naman talo tayo
    . Yes, minsan pumapayag lalo na kung malaki ang tiyan ng sumisita. At alam nyo naman ang susunod na kabanata kung bakit po pumayag, di po ba? Hehehe..... gagastos pa rin kayo kahit certain percentage lamang ng sana ay binayad for that entire year. Again.... depende na po sa locality nyo ang lahat ng iyan at kung gaano kasiba ang mga ulupong o buwaya sa City Hall. :)

  • After registration sa City Hall or municipal hall, we are obliged to secure BIR Registration, mapa micro or small business pa yan. Obligasyon natin ito sa bayan. We cannot possibly invoke or suggest na pede tayong hindi magparehistro. This is the same stance ng TPC na maihahalintulad sa piracy. We have to abide by the law and register.

    Normally, they allow us only about 30 days to register with BIR after securing our DTI Certificates. Kapag nag lapse yon, penalty ka na. Now here is the bad part, hindi naman naiintindihan ng BIR na ubod ng bagal ng proseso sa mga munisipyo at City Hall, na kailangan pang i-sched ang visit ng planning, fire and finally ng business permit group sa shop mo.

    Assuming na makapagparehistro naman tayo sa BIR, kailangang idetermine mo rin kung papaano mo rin ika classify ang shop mo, VAT Exempted ba o hindi? Then since nagparehistro ka, obligado kang magpapirma ng mga libro at magpagawa ng resibo. Medyo shortcut ang explanation na ito, overview lang ika nga, pero that\'s the way it is.

    Kung na-mapping ka at wala ang libro mo sa shop mo (or worse wala ka talagang libro) at pag hinanap ang resibo mo at wala ka rin, o kung meron man, pero walang nakasulat, may mga kaakibat ng mga multa yan. Ang normal na tawag nila dyan ay \"may case\" ka sa BIR.

    Section 7. Exemption from Taxes and Fees – All BMBEs shall be exempt from tax for income arising from the operations of the enterprise.

    The LGUs are encouraged either to reduce the amount of local taxes, fees and charges imposed or to exempt BMBEs from local taxes, fees and charges.

    Section 8. Exemption from the Coverage of the Minimum Wage Law – The BMBEs shall be exempt from the coverage of the Minimum Wage Law: Provided, That all employees covered under this Act shall be entitled to the same benefits given to any regular employee such as social security and healthcare benefits.

  • In summary, Republic Act No. 9178 is called Barangay Micro Business Enterprises (BMBEs) Act of 2002. This Act refers to any business entity or enterprise engaged in the production, processing or manufacturing of products or commodities, including agro-processing, trading and services, whose total assets including those arising from loans but exclusive of the land on which the particular business entity’s office, plant and equipment are situated, shall not be more than Three Million Pesos (P3,000,000.00).

    Incentive and Benefits:
    *Exemption from Taxes and Fees. – All BMBEs shall be exempt from income tax for income arising from the operations of the enterprise.
    *Exemption from the Coverage of the Minimum Wage Law. The BMBEs shall be exempt from the coverage of the Minimum Wage Law. Provided, That all employees covered under this Act shall be entitled to the same benefits given to any regular employee such as social security and healthcare benefits.
    *Credit Delivery. – Upon the approval of this Act, the Land Bank of the Philippines (LBP), the Development Bank of the Philippines (DBP), the Small Business Guarantee and Finance Corporation (SBGFC), and the People’s Credit and Finance Corporation (PCFC) shall set up a special credit window that will service the financing needs of BMBEs registered under this Act
    *Technology Transfer, Production and Management Training, and Marketing Assistance. – A BMBE Development Fund shall be set up with an endowment of Three Hundred Million Pesos (P300,000,00) from the Philippine Amusement and Gaming Corporation (PAGCOR) and shall be administered by the SMED Council.

    The DTI, in coordination with the private sector and non-government organizations (NGOs), shall explore the possibilities of linking or matching-up BMBEs with small, medium and large enterprises, and likewise establish incentives therefor. The data gathered from business registration shall be made accessible to and shall be utilized by private sector organizations and non-government organizations for purposes of business matching, trade and investment promotion.

    Registration and Operation:

    The Office of the Treasurer of each city or municipality shall register the BMBEs and issue a Certificate of Authority to enable the BMBE to avail of the benefits under this Act. The LGUs shall issue the Certificate of Authority promptly and free of charge. However, to defray the administrative costs of registering and monitoring the BMBEs, the LGUs may charge a fee not exceeding One Thousand Pesos (P1,000.00).

    The Certificate of Authority shall be effective for a period of two (2) years, renewable for a period of two (2) years for every renewal.

    As much as possible, BMBEs shall be subject to minimal bureaucratic requirements and reasonable fees and charges.
