DTI Shuts Down Homesonic Appliance Center

The Department of Trade and Industry National Capital Region (DTI-NCR) ordered the temporary closure of Homesonic Appliance Center located in a shopping mall in Mandaluyong City. This is due to the continued influx of complaints against the firm and the sales personnel who allegedly employ deceptive, unfair and unconscionable sales practices.

Starting January 2007, approximately 40 complaints against this company were filed at the Legal Affairs Center (LAC) of DTI-NCR. The usual strategy used by this firms sales staff is telemarketing or approaching customers at the mall to unduly influence them to make a purchase usually through their credit card. These personnel also declare to customers that they won a gift and in order to claim a higher prize, they need to make a purchase.

Assistant Secretary Angel L. Pelayo of DTI-NCR said that the parties involved in these deceptive sales acts leave out material facts which if known to the buyers, they may not have entered the sale: Clearly, there is misrepresentation. Unsuspecting consumers pay exorbitant prices for certain products that they do not really intend to buy.

The Consumer Act of the Philippines (R.A. 7394) Title III Chapter I Article 50 provides for the regulation of sales acts and practices and prohibition against deceptive sales acts or practices. An act or practice shall be deemed deceptive whenever the producer, manufacturer, supplier or seller, through concealment, false representation of fraudulent manipulation, induces a customer to enter into a sale or lease transaction of any consumer product or service.

Homesonic is alleged to have also violated Article 52 of Title III Chapter I because of their unfair or unconscionable sales act. Due to lack of relevant information and lack of time to decide, consumers are induced to make a purchase by the sellers.

Upon examination of the complaints and the attached pieces of evidence in DTIs record, it has been found that this firm has continued its operations, despite repeated complaints against them. We want to see to it that the culprits take on the consequences of their acts. The consumers are our priority. We hope that the public will be more vigilant. If its too good to be true and when in doubt, you can call DTI for information, Pelayo stressed. By virtue of DTI Department Administrative Order (DAO) No. 7, Series of 2006 and Article 159, Chapter III, Title V of the Consumer Act of the Philippines (Investigation of Consumer Complaints), the said establishment was ordered temporarily closed and padlocked. This is to prevent the disposition and tampering of evidence and/or the continuance of the acts complained of.

DTI-NCR Slaps Formal Charge Against Aowa and Homesonic

Aowa Electronic Philippines and Homesonic Appliance Center were formally charged by the Department of Trade and Industry National Capital Region (DTI-NCR) for deceptive and unconscionable sales acts, as cited in Articles 50 (Prohibition against deceptive sales acts or practices) and 52 (Unfair of Unconscionable Sales Act or practice) of the Consumer Act of the Philippines.

Various complaints against Aowa and Homesonic filed at the Legal Affairs Center (LAC) of DTI-NCR date back to 2001 and 2003 respectively. Complainants cite the sales representatives strategy of offering them gifts or prizes to attract them to enter their stores. Later they found out that the offered items are in fact not free items, as they may only be claimed if an additional product is purchased. Usually their credit cards are obtained from them, initially as identification card. After the transaction, they realized that they have already paid for the item that they do not really intend to buy through their credit card. Aowa and Homesonic operate in several major shopping centers in Metro Manila. Aowa has 19, while Homesonic has 11 outlets in the NCR.

Assistant Secretary Angel L. Pelayo vows to crack down other firms engaged in this type of marketing scam: We will not stop in investigating on other alleged scammers. We started issuing formal charge to these two firms, and we will be looking after the others as well. Consumers now should increase their vigilance. Be cautious and well-informed. If you have similar complaints, please feel free to report to us and we will take action. The address of DTI-NCR is at 12th Floor, Trafalgar Plaza 105 H.V. Dela Costa St., Salcedo Village, Makati City.

DTI-NCR issued the formal charge, in accordance with the procedures provided for by Department Administrative Order No. 7, Series of 2006 (DAO 7, 2007). The formal charge asks for the issuance of a cease and desist order, ordering the two firms to permanently cease and desist from continuing in its business operations. An administrative fine will also be imposed for each count that these companies may be proven to have committed.

The public can call DTI Direct at 751-3330 for more information, or visit www.dtincr.ph (end)

Appliance store in hot water for ‘deceptive’ sales

By Elaine Ruzul S. Ramos

The Department of Trade and Industry has filed administrative charges against mall-based Aowa Electronic Philippines for violating Republic Act 7394, or the Consumer Act of the Philippines.

The DTI, through its Consumer Welfare and Trade Regulation Group, has received numerous complaints against Aowa for alleged deceptive sales activities. The CWTRG looked into these complaints to detect patterns.

Acting Trade Secretary Adrian Cristobal Jr., who also heads CWTRG, said under the Consumer Act, sales are deemed deceptive when there is evident misrepresentation of facts.

A sale is also considered unconscionable when the seller, distributor, manufacturer or supplier takes advantage of the consumer’s physical or mental infirmity, ignorance, illiteracy, lack of time or the general conditions of the environment or surroundings to induce the consumer to enter into a sales deal that is grossly one-sided.

A sales act is unfair when the price of the purchased item grossly exceeds the price of similar items in the market.

The first hearing was set on May 19 but postponed to May 23 after Aowa sent an unauthorized representative. DTI rules provide that only authorized personnel may appear before DTI hearing officers to ensure companies that are subject of complaints are properly represented.

The DTI’s Bureau of Trade Regulation and Consumer Protection received 97 complaints against Aowa from 2001 until the first quarter of this year. Out of this, 69 are considered closed cases after Aowa agreed to give refunds to customers or rescind the contracts. Four have been dismissed; 10 were elevated to the DTI’s Office of Legal Affairs; and nine are pending.

Based on the complaints, Aowa sales people are stationed strategically at lobbies of malls to seek prospective clients. They offer promotional coupons/vouchers for corresponding chances to win Aowa-branded appliances for free. Upon closer evaluation of the promotion, complainants allege that they actually pay for these so-called freebies.

Complainants who have been lured into Aowa outlets also cited the overbearing presence of Aowa sales people. For instance, one immediately finds a customer swarmed by sales personnel upon entering the store. This, as claimed by several of the complainants, have affected their decision-making.

• up natin.

beware guys...

May free gift pa kuno plus paraffle. May tawagan pa daw kuno from Ilocos to Manila \"for confirmation.\" Pinahawak pa sa akin yung cellphone, may tawag nga. Pero in order to claim the prize, bibili daw ako ng appliances worth 55K. I weaseled out of it.

Katunayan, naibalita ito sa TV Patrol World...
• Scam yan. Nangyari nga lahat ng naloko nyan nagjoin force sabay sabay sumugod hehehe!
• May tumawag sa tita ko kanina from home sonic appliance center saying na, nabunot daw yung name ng tita ko, they gave her a reference number and she needs to claim her prize at homesonic appliance center sa ground floor ng starmall mandaluyong within 3 days. this is in celebration ng 25th anniversary na offer daw ng PLDT. so nagulat yung tita ko kasi alam nung caller yung mga details regarding sa kanya, like yung name, phone number and address. right now kinukulit ako ng tita ko na puntahan daw namin and to claim the prize which is very weird kasi wala naman kami sinsalihan na kahit anong game or promo even PLDT itself, so i think na modus operandi ito ng mga sindikato. i immidiately search the internet and i was surprise na madami n pala complaints to them. Thanks TPC forum for enlightening us on this and also to those who unfortunately defruad by this swindlers.

Guys, be ware to this groups or anyone who are offering anything to you for free.

More power to TPC..

Nung i follow up ko ung gift, guess what.. So namula yung salesman.

Eto yung remarks,

Di raw transfrrable,
last part nun.. kailangan magamit mo sya sa mga participating items na ifafax daw... so Me fax ngang dumating, bibili ka ng items nila na ang pinaka mura ay 48000.00 less mo yung 2K , bali 46K... So sabi ko wala akong pera, pwede daw card (me idea sila na me card ka kasi ginamit mo nga pambili ng appliances diba), or COD pwede daw.
